Ethics in Education Act 1012.315
Disqualification from Employment
The Act disqualifies from employment and/or certification any person who is on the disqualification list, is registered as a sex offender, or has been convicted or found guilty of, has had adjudication withheld for, or has pled guilty or nolo contendere to any of the disqualifying offenses listed below. Person is defined as anyone whose position requires direct contact with students in a district school system.
CONVICTED, FOUND GUILTY of, has had ADJUDICATION WITHHELD for, or has PLED GUILTY or NOLO CONTENDERE to any of the following FELONY offenses:
Sexual misconduct with developmentally disabled clients.
Sexual misconduct with mental health patients.
Adult abuse, neglect, or exploitation of aged or disabled adults.
Murder.
Manslaughter, aggravated manslaughter of elderly or disabled adult, aggravated manslaughter of a child, aggravated manslaughter of an officer, a firefighter, an EMT or a paramedic.
Aggravated assault.
Aggravated battery.
Battery on a detention or commitment facility staff member or juvenile probation officer.
Kidnapping.
False imprisonment.
Luring or enticing a child.
Leading, taking, enticing, or removing a minor beyond the state limits, or concealing the location of a minor, with criminal intent pending custody proceedings.
Leading, taking, enticing, or removing a minor beyond the state limits, or concealing the location of a minor, with criminal intent pending dependency proceedings or proceedings concerning alleged abuse or neglect of a minor.
Exhibiting firearms or weapons at a school-sponsored event, on school property, or within 1,000 feet of a school.
Possessing an electric weapon or device, destructive device, or other weapon at a school sponsored event or on school property.
Sexual battery.
Sexual activity with or solicitation of a child by a person in familial or custodial authority.
Unlawful sexual activity with certain minors.
Female genital mutilation.
Prostitution.
Lewdness and indecent exposure.
Offenses against students by authority figures.
Arson
Voyeurism
Video Voyeurism
Theft in excess of $3,000.
Theft from persons 65 years of age or older.
Dealing in stolen property.
Robbery
Robbery by sudden snatching.
Carjacking.
Home-invasion robbery.
Fraudulent sale of controlled substances.
Abuse, aggravated abuse, or neglect of an elderly person or disabled adult.
Exploitation of an elderly person or disabled adult.
Lewd or lascivious offenses committed upon or in the presence of an elderly person or disabled person.
Incest.
Child abuse, aggravated child abuse or neglect of a child.
Contributing to the delinquency or dependency of a child.
Sexual performance by a child.
Resisting arrest with violence.
Obscenity.
Causing, encouraging, soliciting, or recruiting another to join a criminal street gang.
Drug abuse if the offense was a felony of the second degree or greater severity.
Sexual misconduct with certain forensic clients.
Introduction, removal, or possession of contraband at a correctional facility.
Sexual misconduct in juvenile programs.
Introduction, removal, or possession of contraband at a juvenile detention facility of commitment program.
CONVICTED, FOUND GUILTY of, has had ADJUDICATION WITHHELD for, or has PLED GUILTY or NOLO CONTENDERE to any of the following MISDEMEANOR offenses:
Battery if the victim of the offense was a minor.
Luring or enticing a child.
CONVICTED, FOUND GUILTY of, has had ADJUDICATION WITHHELD for, or has PLED GUILTY or NOLO CONTENDERE to any criminal act committed in another state or under federal law which, if committed in this state, constitutes an offense prohibited under any statute listed under the FELONY section or MISDEMEANOR section.
CONVICTED, FOUND GUILTY of, has had ADJUDICATION WITHHELD for, or has PLED GUILTY or NOLO CONTENDERE to any delinquent act committed in this state or any delinquent or criminal act committed in another state or under federal law, if committed in this state, qualifies an individual for inclusion on the Registered Juvenile Sex Offender List.
